November 15 Judge ends dismissal of meritless lawsuit against Tether and Bitfinex, plaintiff drops appeal

Following an order by Chief Judge Laura Taylor Swain of the US District Court for the Southern District of New York denying Sean Dolivka's request for leave to amend his meritless class action complaint against Tether and Bitfinex, Dolivka chose not to appeal the decision. Judge Swain's dismissal of the lawsuit and ruling in favor of Tether and Bitfinex are now final in all respects.
Unlike Dulevka's ill-advised decision to file the lawsuit in the first place, his decision to waive his appeal rights was the right one. His claims were completely baseless, and no amount of additional litigation would result in Dolevka or his attorney achieving anything, monetary or otherwise. Here and from now on, as we have said many times before, Bitfinex and Tether will never fall prey to shameless litigation money grabbing.
