In February 2023, J6 political prisoner Frank Rocco Giustino pleaded guilty to parading, demonstrating, or picketing the Capitol Building, a misdemeanor.
Frank was sentenced to three months in prison for walking into the US Capitol and then confronting a lying Justice Department prosecutor during his show trial in D.C.
On Monday, Frank was released and returned to Florida to start his new life.
Frank shared a message with The Gateway Pundit.
J6 Case No. 23-cr-16 (US District Court)
Pending SCOTUS Status Habeus Corpus No. dated 11/12/23.
I attended J6, 2021, because of the terrible behavior displayed by our society in response to the coronavirus lockdown on March 13, 2020 (my birthday!) in the United States and the very clearly partial treatment received by those of us who were open to criticizing it by the so-called government and civil servants during That period.
Coming from a family of medical practitioners and being a health practitioner myself, I have been appalled at the lack of sensitivity by so-called “friends” and medical “experts” alike, as our society as a whole has quickly escalated to the “C word.” As businesses closed their doors and our communities were burned to the ground: either through intentional or unintentional communism that our friends and neighbors were practicing without question or adequate hesitation. I entered 2020 with new boundaries than the previous year, which certainly prepared me for the worst of the social acceptance trials the year offered, and I certainly did not expect to become a staunch Trump supporter by the end of the year — having never had a political affiliation before, before.

A seemingly tamed FBI arrest based on a complaint in 2022 that went uncharged for over a year for being part of a “bottom of the barrel” J6 misdemeanor case quickly descended into something else entirely when she decided to take an alternative approach by My Independent Research, Only Ability to Afford a Court-Appointed Public Defender: A Comprehensive Application and Documented and Signed Oath Investigation of U.S. District Court Judges Presiding over January 6, 2021 Cases Like Mine.
Although both the Solicitor General and the Attorney General at the Department of Justice told me early on during the plea bargain negotiations that I signed the bond for office that it did not exist, I quickly demonstrated that this was not true and discovered even more that this was not a lie. Not only was it a potential cover-up for something greater: the written oath of office for many DC “judges” (including outside DC!) did not conform to the Judicial Oaths Act (28 USC Section 453) as enshrined in Congress: void ab initio .
The “judges”, including past and present “Chief Justices” Howell and Boasberg, who oversee all the J6 cases and then some, are only pretending to be legal judicial officers, whether they know it or not! Even the American prosecution through Garland was proven in the court record to have a defective written oath!
Once I gained professional status (later representing myself at sentencing), to say that the D.C. federal “court” and the district attorney treated me unfairly for properly addressing their judicial “authority” is an understatement.
Immediately, the prosecutor tried to publicly accuse me of being an instigator, specifically excluding exculpatory evidence of my attempt to subdue the conflict – peacefully, in a specific scene in front of the crowd. This case of attempted public character assassination after it was initially strongly implied that I would likely not receive prison time during plea deal negotiations, is one of the few ways in which these judicial representatives attempted to influence my case and its outcome. This is the case in any J6 case, among the many ways in which the federal government has tried to influence our lives, and not necessarily in order to achieve truth and justice.

Requiring or questioning the oath should not be punished in court, and has nothing to do with “sovereign citizenship” – often a contradiction – as a signed document held by the Department of Justice itself. What do they have to hide from that? Seems like a lot.
I haven't asked for much throughout my case, but of course I'm always open to support. In any way anyone chooses to give it, I await the end of this ruling over the next few weeks anticipating my release, and preparing for the plethora of lawsuits I wish to bring against everyone who has opposed our freedoms.
I'm new to Florida having only moved there a month before prison, and I come from living on Long Island, NY all my life and working as a massage therapist and holistic practitioner there. I'm looking forward to making new clients and/or connections here, meeting like-minded friends, trying new things and getting better at the local beaches and restaurants.
I'm required to take better care of myself and my body after the J6 prison experience, so anything helps. Enjoying my life is the priority, I have worked hard.
There's a lot to do, but I won't worry. The tides can turn in an instant, and it's not what it seems. God bless America…and the love and life of this world!
