Three former prosecutors file brief insisting Trump is constitutionally eligible to appear on ballot | Critic portal

Three former attorneys general, including Bill Barr who is not even supporting Trump in 2024, have filed a brief insisting that Trump is constitutionally eligible to appear on the ballot.

The move comes in response to efforts in Colorado, Maine and other states where leftists have sought to remove Trump from the 2024 ballot.

The argument of these former DAs was crafted with the help of law professors and is very strong.

    Breitbart News reports:

Former prosecutors file amicus curiae brief insisting Trump is constitutionally eligible to vote

Three former US attorneys general – including Bill Barr, who is not supporting Donald Trump's campaign for the Republican nomination – insist that Trump is constitutionally qualified to run for president, in a brief their lawyers filed with the US Supreme Court on Thursday.

Along with Barr, former Republican Attorneys General Edwin Meese III and Michael P. Mukasey, as well as several law professors, make up the amicus curiae. Trump v. Anderson Brief. After the Colorado Supreme Court ruled 4-3 that Section Three of the 14th Amendment, known colloquially as the “Insurrection Clause,” barred Trump from the ballot, his legal team and the Colorado Republican Party challenged the effort.

The brief, filed by attorney Gene Schaerr of Schaerr Jaffe LLP, argues that the Colorado court's decision is a “misrepresentation” of the provision, and if upheld, “the ruling would create a precedent with severe consequences for our democratic republic.”

This is the essence of their argument:

This is evident in the text of Section 3, which omits the office of president, and instead designates specific positions such as senator and representative. Earlier versions of the proposed text included the president and vice president, but later versions excluded those two offices, instead excluding presidential electors who would choose the incumbents and vice president.

What the left is trying to do is patently ridiculous.

They claim to be trying to “save democracy” while actively working to destroy it.
