    Judge rejects request to dismiss charges against New York City subway hero Danielle Penny Critic portal

    A judge has denied Danielle Penny's attorney's requests to dismiss the charges against him.

    You may remember that Benny busted Jordan Neely for threatening people on the New York City subway and Neely died shortly after. Of course, Benny was just trying to stop Nellie from hurting the people on the train and didn't act alone. Others helped restrain Nellie.

    Benny was hailed as a hero by the people on the train and felt threatened by Nellie.

    The worst thing about this situation, besides the injustice, is that people will not step in to help others as much in the future. Why do they do that? The authorities will come after you if something goes wrong.

    NBC News in New York reports:

    A judge will not dismiss the subway suffocation death case against U.S. Marine Corps vet Daniel Penny

    A judge has denied a request by lawyers for Daniel Penny, the US Marine who put Jordan Neely in a fatal chokehold on a New York City subway last year, to dismiss the case.

    The decision came in court on Wednesday. The judge ordered Penny to return to court in late March. His trial is tentatively expected to begin in the fall.

    Penny's attorneys, Stephen Reiser and Thomas Kenniff, said they disagreed with the judge's decision.

    “While we disagree with the court’s decision not to dismiss the indictment, we understand that the legal threshold for proceeding even with an ill-advised trial is very low,” Raiser and Kenniff said in a statement. “We are confident that the jury, recognizing Danny's actions in putting aside his own safety to protect the lives of his fellow riders, will render a fair verdict. Danny is grateful for the continued prayers and support during this difficult process.”

    Benny should be acquitted of these charges.

    Today, the judge rejected his request to drop the charges against him.
