President Trump again asked Judge Tanya Chutkan to hold Special Counsel Jack Smith in contempt for violating her order halting all proceedings in the January 6 case against Trump.
Last month, Obama-appointed judge Tanya Chutkan halted Trump's case on January 6 in D.C. amid a dispute over the former president's immunity argument.
“Plaintiffs' filings and products, Exhibits 188 and 191, attempt to achieve both of these unlawful goals,” Trump's lawyers wrote in a memo accusing Jack Smith of “willfully, repeatedly and flagrantly violating the court's stay order.”
Trump's legal advisor Jack Smith was accused of illegally filing requests to flood the media with anti-Trump headlines.
“It is no coincidence that the Biden campaign, prosecutors, and ‘sources’ close to the prosecutors are simultaneously trying to flood the airwaves with anti-Trump rhetoric during his stay,” Trump’s lawyers wrote.

This is the second time Trump has asked the court to hold Jack Smith in contempt in the January 6 case in D.C., in which the special counsel charged him with four counts: conspiracy to defraud the United States, conspiracy to obstruct an official proceeding, and obstruction and attempt to obstruct an official proceeding. “The stay order is clear, direct, and unambiguous. All substantive proceedings in this court are stayed. Despite this clarity, prosecutors began violating the stay order almost immediately. First, within five days of the court issuing the stay order, prosecutors filed “Thousands of pages of additional discovery, along with a draft list of alleged evidence. Through counsel, President Trump communicated that he rejected prosecutors' unlawful advances, that their actions violated the stay order, and that he would seek redress if their malicious conduct continued,” Trump's lawyer Todd Blanche wrote.
Jack Smith responded to Trump's lawsuit asking a judge to hold him in contempt of court. He said he did not violate Chutkan's stay order because he was filing discovery before the pretrial deadlines.
All pretrial proceedings are on hold pending a decision from the Court of Appeals or possibly SCOTUS, but that hasn't stopped Jack Smith from filing.
Last month, Jack Smith filed a motion with the court to block President Trump from blaming instigators and secret agents for the Jan. 6 Capitol riot.
President Trump previously attacked Jack Smith for filing an “illegal” request in another attempt to silence him and take away his First Amendment rights.
