Alexander Smirnov, the FBI's secret human source who blew the whistle on Biden-Burisma bribery scheme, has been arrested once again On the same charges Thursday after federal prosecutors deemed him a flight risk.
Smirnov, a dual citizen of Israel and the United States, was released from pretrial detention by Las Vegas-based Judge Daniel Albregts. Prosecutors urged Albregts to keep Smirnov behind bars because he has “ties to Russian intelligence officials” who could help him escape. They also claimed that Smirnov had access to millions of dollars and could flee on an Israeli passport.
Albregts refused to detain Smirnov. He didn't believe what federal prosecutors were alleging.
“I understand the concern about the possibility of foreign intelligence agencies resettling Mr. Smirnov outside the United States, and his ties to the United States, but I think this is just speculation on some level,” Albregts said, according to Politico. “Because, as Mr. Chesnov pointed out, I don't know what Mr. Smirnov would think of Russia, but I think at this point he probably thinks that's not the most attractive place to go either if he's actually inclined to go hide somewhere.”
Prosecutors filed additional charges against Smirnov in California after a Vegas magistrate declined to arrest him.
Smirnov was arrested Thursday while meeting with his attorney, indicating he is unlikely to be a flight risk.
“On the morning of February 22, 2024, Mr. Smirnoff was arrested for a second time – on the same charges and based on the same indictment,” his attorney, David Chesnoff, wrote in a lawsuit.
Biden's Justice Department now alleges that the FBI informant who was arrested and charged was “actively promoting new lies that could impact the US election after meeting with Russian intelligence officials in November.”
Alexander Smirnov was indicted for the first time last week by Hunter Biden's special counsel, David Weiss, on charges of making a false statement to the FBI and “creating a false and fictitious record.”
Smirnov was the primary source of the Biden-Burisma bribery allegations. According to Smirnov, Burisma Holdings founder and Ukrainian oligarch Mykola Zlochevsky told him he had paid a total of $10 million in bribes to Hunter and Joe Biden. There are text messages and audio recordings to support these claims.
Recall that last July, Senator Chuck Grassley released an FBI document showing Joe Biden's involvement in a $10 million bribery scheme with Burisma CEO Mykola Zlochevsky.
Form FD-1023 alleges that then-Vice President Joe Biden forced Zlochevsky, a Ukrainian oligarch, to pay himself and his son Hunter Biden a total of $10 million.
Alexander Smirnov never spread Russian disinformation. He was a Confidential and Trusted Human Source (CHS) that the FBI relied on for 10 years and they paid him over $100,000 for information.
Democrats are using Smirnov's arrest to torpedo the Biden impeachment investigation since House Republicans relied on Burisma whistleblower documents released by Senator Grassley in their investigation.
Smirnov was rearrested Thursday morning, and his lawyers are now asking a federal judge in California to hold an emergency hearing.

Lawyers for Alexander Smirnov, the former FBI informant accused of feeding the bureau false corruption allegations against Joe Biden, have been rearrested just days after a Las Vegas magistrate judge ordered him released from pretrial detention.
Smirnov — who prosecutors warned had extensive ties to Russian intelligence and was a flight risk — was meeting with his lawyer at the time of his second arrest, which was based on a memo signed earlier Thursday, Chesnov said. They called the development “bizarre” and urged a federal judge in California — where Smirnov's charges were filed — to quickly call a hearing on the matter.
“It should also be noted that the fact that defendant attended a legal counseling meeting at his attorney’s office belies the notion that he is a flight risk,” Chesnoff wrote.
Prosecutors have asked Los Angeles-based U.S. District Judge Otis Wright II to overturn Albregts' decision, but Wright has not yet scheduled a hearing. Smirnoff's attorneys are asking Wright to schedule a hearing immediately in light of their client's new arrest.
