A legal challenge to block Trump from the 2024 ballot in Massachusetts has failed… so far.
The Massachusetts Ballot Law Commission this week rejected a challenge to bar Trump from the 2024 primary ballot, citing the 14th Amendment.
“We believe that nominating Mr. Trump for this office and placing him on the ballot in Massachusetts violates the Constitution, so we are challenging constitutionality,” said Shannon Lees Riordan, the challengers’ attorney, according to CNN. “It is the job of this committee to hear objections to the legality of placing candidates on the ballot.”
The legal theories are based on Section 3 of the Fourteenth Amendment to the US Constitution which states that public officials who “engage in rebellion or rebellion against” the United States may be disqualified from public office.
Trump has not been accused of involvement in insurrection or rebellion against the United States.
“The committee dismissed the case on procedural grounds on Monday, finding that the committee did not have the judicial authority to address the matter,” CNN reported.
President Trump is currently facing similar challenges in other states. Legal challenges have escalated significantly in Maine and Colorado.
Last Wednesday, the Supreme Court in Maine ordered Trump to return to the ballot pending a decision from the US Supreme Court.
President Trump appealed Maine Secretary of State Sheena Bellows' 2024 ballot ban to the state Supreme Court last Tuesday.
Last month, Democratic Maine Secretary of State Sheena Bellows unilaterally banned Trump from participating in the 2024 election because she decided the former president was insurgent.
Earlier this month, President Trump asked the US Supreme Court to overturn the Colorado Supreme Court's decision to bar him from the 2024 ballot.
Last month, the Colorado Supreme Court excluded Trump from running in the 2024 elections.
The United States Constitution stipulates three requirements to be president:
- Be a born citizen of the United States.
- You must be at least 35 years old.
- I have been a resident of the United States for 14 years.
The Massachusetts poll commission's decision can be appealed.
