In an unprecedented legal challenge, four Republican plaintiffs have filed a lawsuit in Illinois seeking to deny President Joe Biden an appearance on the state's ballot for the upcoming presidential election.
The lawsuit alleges that the president's immigration and border policies provided “aid or comfort to enemies,” in violation of the 14th Amendment to the U.S. Constitution.
Section 3 of the Fourteenth Amendment states:
No person shall be a Senator or Representative in Congress, or an Elector for President or Vice-President, or hold any office, civil or military, under the United States, or under any State, who shall have previously been sworn in as a Member. As a member of Congress, or as an employee of the United States, or as a member of any state legislature, or as an executive or judicial officer of any state, in support of the Constitution of the United States, he shall have engaged in insurrection or rebellion against himself, or Providing aid or comfort to its enemies. But Congress may, by a two-thirds majority of each House, eliminate this deficit.

“In Illinois, candidate Joe Biden has been sued by Terry Newsom and others to remove Biden from the ballot.
The lawsuit alleges that under the 14th Amendment, Joe Biden provided “aid or comfort to his enemies” through his open border policies.

According to the lawsuit:
Beginning on January 20, 2021, Joseph Biden has willfully refused to enforce the laws of the United States, particularly regarding the security of our nation's borders. Exhibit A, Biden Administration Actions That Undermined Border Security and Encouraged Illegal Immigration, identifies 64 distinct actions taken by Biden, at his direction, or with his approval. These actions have provided assistance or relief to enemies of the United States contrary to Art. 3.
Among the actions mentioned are not merely political decisions, but rather active and intentional actions that are contrary to the laws of the United States, including but not limited to:
- Illegal transfer of funds intended for the border wall
- Violating court orders declaring DACA illegal
- Illegally declared a moratorium on deportations
- Contrary to the law, creating unauthorized alternatives to removal
- Unaccompanied illegal alien children are exempt from Article 42
- The illegally created Central American Minors Program conflicts with federal law governing family immigration proceedings
- Following the Arrest and Release Protocol, this contravenes Congress' mandate to “detain” illegal aliens.
- Canceling the construction of the wall by department
Defense as authorized by Congress- More than 150,000 foreigners were released without notice to appear in court, in violation of the law
- Issues a memorandum stating that “the individual is removable [alien] He should [not be the sole] basis for an executive action,” contrary to law
- Widespread suspension of law enforcement at work sites, a key tool to deter recruitment and employment of illegal aliens, and intentional failure to enforce the law

The plaintiffs cite the Fourteenth Amendment, which states that no person shall hold office if he participates in insurrection or rebellion against the United States, or gives aid or comfort to its enemies. They argue that Biden, by maintaining “open border policies,” has violated this provision.
Prosecutors assert that by not imposing stricter border controls, the Biden administration allowed potential adversaries to exploit the situation, posing a significant threat to the safety and well-being of American citizens.
As The Gateway Pundit reported, US intelligence officials have warned of the growing threat posed by the Lebanese terrorist group Hezbollah, suggesting it could strike US interests in the Middle East or even within the United States.
One official, who was granted anonymity to discuss sensitive intelligence, expressed concern about Hezbollah's ability to carry out an attack in the United States, saying: “Hezbollah could leverage its capabilities to identify the locations of individuals for a potential attack.” It is a matter of concern.
In October, during a speech to the International Association of Chiefs of Police conference in San Diego, California, FBI Director Chris Wray issued a stark warning about the rise of violent extremism, both domestically and internationally.
Wray noted that there had been a significant rise in reported threats following attacks in Israel, and warned the public to remain vigilant against “lone actors.”
“In this heightened environment, there is no doubt that we are seeing an increase in reported threats, and we need to be on the lookout, especially for lone actors who may be inspired by recent events to commit acts of violence of their own.”

The complaint asserts that Joe Biden's failure to retain an Illinois notary, as required by Illinois election law, makes him ineligible to appear on the ballot in Illinois.
