Today, Chief Judge Laura Taylor Swain of the U.S. District Court for the Southern District of New York issued another categorical decision denying Sean Dolevka's request for leave to amend his meritless class action complaint against Tether and Bitfinex. The court noted that Dolevka attempted to raise arguments that were “already objectionable” and that his proposed amended complaint failed to correct fundamental flaws in his claims. A ruling will soon be issued against Dolifka and in favor of Tether and Bitfinex.
As previously noted, the dismissal of the class action in its entirety at this stage of the proceedings highlights the fact that the plaintiff's claims were devoid of any legal merit. Now and in the future, as we have said many times before, Bitfinex and Tether will never fall prey to shameless litigation money grabbing. All plaintiffs and their attorneys who have attempted to file these cases in the past — and any individuals who attempt to file these cases in the future — will be left with the same amount: $0.
