A new landmark wrongful death and negligence lawsuit on behalf of Jan. 6, 2021, details the estate of police murder victim Ashli Babbitt, Officer Michael Byrd's incompetence and multiple revocations of his firearm privileges in prior serious incidents.
Judicial Watch has filed a $30 million wrongful death lawsuit against the federal government over the Capitol Police shooting of Air Force veteran Ashli Babbitt, The Gateway Pundit reported Friday, one day before the third anniversary of Jan. 6.

The lawsuit was filed in the U.S. District Court for the Southern District of California.
“Ashley loved her country and wanted to show her support for President Trump’s “America First” policies and see and hear the President speak live while he remained in office. Ashley did not go to Washington as part of a group or for any illegal or nefarious purpose. She was there to exercise what she believed were freedoms And God-given American freedoms.
The file continues: “After demonstrators filled the hallway outside the lobby, two individuals in the crowded, crowded lobby struck and dislodged the glass panels in the lobby doors and the right side door light. Lt. Byrd, a USCP commander who was the incident commander at the home on January 6, 2021, shot Ashley was in plain sight as she lifted herself into the right side door light slot. Lt. Byrd later admitted that he shot Ashley before he saw her hands, assessed her intentions, or even recognized her as female. Ashley was unarmed. Her hands were in the air, empty, and in plain sight of Lieutenant Byrd and the other officers in the hallway.“

The lawsuit was filed on behalf of Babbitt's estate and her husband, Aaron Babbitt, and claims the officer who shot Babbitt was “incompetent” and “dangerous” and should have realized that Babbitt posed no threat to Congress when she entered Congress, the Washington Examiner reported. “The only murder that occurred on January 6 was the unlawful shooting death of Ashli Babbitt. Her murder was at the hands of Lt. [Michael] Bird is a scandal beyond imagination. Tom Fitton, head of the judicial watchdog, said: This historic lawsuit seeks to achieve a measure of justice and hold the government accountable for the wrongful killing of Ashley.
The lawsuit alleges that Babbitt was not a threat to lawmakers and that Byrd had a sloppy record of gun play.
For example, she alleged that Byrd once left his Glock 22 pistol, which was used to shoot Babbitt, in a public bathroom. It also claimed that Byrd shot at a car that had allegedly been stolen by teenagers.
The joint lawsuit with Secrets also said he had had his police powers suspended in the past for “failing to meet or complete semi-annual firearms qualification requirements,” adding that “Lt. Byrd had a reputation among his peers because he was not a good shot.”

The lawsuit says that, based on prior incidents involving Lt. Byrd, the Capitol Police, the Capitol Police Board, and ultimately Congress, as Lt. Byrd's employer, “knew or should have known that Lt. Byrd was susceptible to behaving in a dangerous or “Dangerous.” Incompetently:
Less than two years before January 6, 2021, on or around February 25, 2019, Lt. Byrd left his loaded Glock 22 pistol — the same firearm he used to shoot and kill Ashli Babbitt — in the bathroom of the Capitol Visitors Center (CVC) complex. Lt. Byrd's loaded Glock was discovered during a routine security sweep later the same day. Approximately 15,00 to 20,000 people pass through the CVC, which serves as the main entrance for visitors to the U.S. Capitol, daily during peak season (March-July). Lawmakers and staff charged with overseeing the USCP were not informed of the incident until contacted by a reporter.
Lt. Byrd's police powers were revoked on more than one occasion prior to January 6, 2021, for failing to meet or complete semi-annual firearms qualification requirements. In fact, Lieutenant Byrd had a reputation among his peers for not being a good player. Under the USCP's range management system, an officer who fails to meet firearms qualification requirements is given one week of remedial training. If an officer still fails to qualify after remedial training, his police powers are revoked until the officer qualifies.
Lieutenant Byrd's police powers had also been revoked for a previous period Off-duty shooting involving a stolen moving vehicle with teenagers or juveniles as occupants. The stolen car was Lieutenant Byrd's car. Lt. Byrd fired several shots at the fleeing car in the suburbs. Stray bullets from Lieutenant Byrd's firearm hit the sides of nearby homes. An official investigation concluded that Lieutenant Byrd's use of force was unjustified.
Previously, Judicial Watch received a memorandum regarding the January 6 shooting that “recommends” the U.S. Attorney's Office for the District of Columbia decline criminal prosecution for the fatal shooting of Ashley McEntee. [Babbitt]”, also noting that the shooter, US Capitol Police Lt. Michael Byrd, “did not prepare a police report or documents” related to the shooting of Babbitt, the watchdog said.
If this had been any other police officer in America, or if the victim had been a left-wing protester or black street thug, left-wing groups would have revolted, and the officer would have been fired. Why is Robert Byrd being treated differently than Derek Chauvin, the officer who pleaded guilty to federal charges in the 2020 death of 46-year-old George Floyd, which sparked dangerous and costly riots across the country?
