True the Vote (TTV) declares a decisive victory in its legal battle against Stacy Abrams' Fair Fight, legal teams led by Marc Elias, and Biden's Justice Department. A federal court in the Northern District of Georgia today affirmed that citizens have the right to legally petition their government to uphold the integrity of elections without fear of persecution or prosecution.
In a resounding defense, TTV successfully defended its actions in December 2020, helping Georgia citizens file election challenges based on data showing that more than 364,000 voters appeared to be ineligible to vote due to a change of residence.
This victory is a testament to the constitutional right of every American to freedom of expression and the importance of effective participation in the electoral process.
“Today's ruling sends a clear message to those who would try to control the course of our nation through lawfare and intimidation. American citizens will not be silenced,” True the Vote President Katherine Engelbrecht emphasized.
“After nearly three years of litigation and a two-week federal trial with Plaintiff calling 12 witnesses, Judge Stephen Jones has entered a full defense judgment for all defendants,” said True the Vote's lead attorney, Jake Evans. “This decision is monumental. It fully vindicates True the Vote.” “It proves that Section 230 eligibility challenges are an appropriate way to ensure the accuracy of voter rolls. I am grateful to help achieve this great victory.”

Our efforts were immediately met with a lawsuit filed against us by attorney Mark Elias on behalf of Stacey Abrams' Fair Fight organization. The Ministry of Justice has now joined the “just fight against us.” This case has been ongoing since December 2020. Our trial in federal court in Georgia begins on October 26, 2023. |
Accusations |
Now, nineteen people, including Donald Trump, have been indicted by Fulton County District Attorney Fanny Willis. It charged them with multiple criminal counts over their involvement in the 2020 election, each explicitly related to whether known inaccuracies that could determine the results in the Georgia election were covered up. |

After seeing this, I decided to take what I wrote in the Return and turn it into an affidavit. A notarized copy is attached here for your use in any way that may be helpful. Here is an excerpt: |
“… I left the meeting feeling unsettled by the apparent indifference shown by Raffensperger's team about their knowledge that voter rolls were noticeably inaccurate during the November election. At that time we did not yet have a copy of the state's published voter register for the general election, but because The country uses services such as ERIC, Which also uses NCOA to identify ineligible records. The Secretary of State's office knew, or should have known, that there were hundreds of thousands of ineligible voters who cast ballots, hence Raffensperger's warning that “the Republican Party should have been doing this all along.” “. |
8. Just over two weeks later, on January 2, 2021, Secretary Raffensperger and members of his team held a phone call with President Trump and members of his team. In that call, President Trump asked about inaccurate voter records. Both Secretary Raffensperger and General Counsel Ryan Germany said they have fully evaluated the various allegations of election irregularities and have said without reservation that there is no evidence to support them, including the absence of problems with voting records. This statement was intentionally false. Both men were well aware of this falsity at the time. |
9. True the Vote completed a review of voting patterns related to the 364,541 records identified as ineligible based on permanent change of residence. |
10. In the November 2020 election in Georgia, approximately 67,284 votes were cast that likely would not have been counted because voter registrations were ineligible based on permanent change of residence. |
a. Out of county. 48,207 of those votes correspond to voters who moved to a different county within Georgia. |
B. Out of state. 19,077 of those votes correspond to voters who no longer live in Georgia. |
11. While we cannot know who voted for which candidate in those ballots that were not supposed to be counted, we do know that only 11,779 votes separated the two presidential candidates. It is of grave concern that the number of votes that essentially waived the address verification requirement in the 2020 general election could have been a deciding factor in determining the outcome. |
After consequences |
This week, Secretary Raffensperger announced efforts to evaluate, deactivate, or remove voter registration records for 679,749 ineligible voter records. |
While we applaud what appear to be efforts to ensure that only eligible voters vote in 2024, there were no such efforts in 2020. According to available state and federal data, there were more than 300,000 ineligible records on the rolls, and more than 67,000 appear to have died. An ineligible voter has been voted. |
It was not only appropriate for leaders to question the accuracy of the 2020 general election, it was their duty to do so. |
